§ 12.84.010. Violation—Penalty.

    A violation of a provision of Chapters 12.44, except for Sections 12.44.260 and 12.44.270, 12.48, 12.52 and Sections 12.56.030 and 12.56.040 of this Code governing the stopping, standing or parking of a vehicle, or a violation of any stopping, standing or parking designation, regulation or restriction established as authorized by said chapters, is a civil offense; provided that the penalties for a violation of Section 12.44.280 shall be as set forth in subsection 12.44.280 R. Such civil violations are subject to the administrative adjudication process as provided in Chapter 12.85 of this Code.

    B.

    Any person violating any provision of this title, other than a provision of Chapters 12.44, except for Sections 12.44.260 and 12.44.270, 12.48, 12.52 and Sections 12.56.030 and 12.56.040 of this Code governing the stopping, standing or parking of a vehicle, shall be deemed guilty of a misdemeanor and be punished by a fine not exceeding five hundred dollars; provided, if any provision of this title is substantially the same as one set forth in any statute of this state, and a different penalty therefor is provided by state law, the penalty provided by this title for violation of such provision shall be the same as that provided by the state law; and provided further that the penalties for a violation of Section 12.44.280 shall be as set forth in subsection 12.44.280 R.

    C.

    For violations under this title that are of a continuing nature, each day that the violation shall continue shall constitute a separate offense, except that continuing violations of Section 12.56.040 relating to time limits for parking in metered parking spaces, and continuing violations of Section 12.52.050 relating to time limits for parking as established by code schedule when signs are erected, shall constitute a separate offense for each segment of maximum parking time as allowed and stated on the meter or sign.
