§ 2.64.270. Pension applications—Hearing—Investigations.

  • The board of trustees shall hear all applications for pensions or benefits under this chapter, after giving written notice to the applicant and posting a public notice of such hearing on the bulletin board in the city hall for at least seventy-two hours before such hearing. Such public notice shall state the time and place of such hearing, the name of the employee whose rights, or the rights of whose beneficiaries, are the subject of the hearing, and the names of all persons claiming such rights and their relationship to the employee. Any person interested in the pension fund may appear in person or by attorney and contest such application. In connection with such hearings or with investigations of any other matter within its jurisdiction the board may require witnesses to give testimony and may issue subpoenas and subpoenas duces tecum, which may be served by any police officer or any person designated by the board of trustees. When the condition of health of any person receiving or claiming a pension or benefits under this chapter is material, the board of trustees may require such person to undergo a medical examination or examinations by a physician satisfactory to the board, and upon refusal to undergo such examination or examinations the board may diminish, discontinue or disallow such pension or benefits.
