§ 2.64.130. Participation in pension system—City-county health district employees.

  • The provisions of this chapter are extended to all employees of the El Paso City-county health and environmental district and all provisions of this chapter shall be applicable to such employees until December 31, 2007.

    For former employees of the El Paso City-county health and environmental district admitted into the city civil service system as city employees (hereafter, "admitted employees"), pursuant to Section 6.13E of the El Paso City Charter, under certain terms and conditions, effective January 1, 2008, all provisions of this chapter shall be applicable to such employees except as follows:

    A.

    Any former employee of the city-county health district who becomes a city employee on January 1, 2008 shall automatically have their pension service credit earned as a district employee transferred to their service as a city employee;

    B.

    Any former district employee who becomes a city employee on January 1, 2008 shall receive credit for pension purposes for unused sick leave earned while a district employee and that remains unused at the time of the employee's retirement date;

    C.

    Any former district employee who becomes a city employee on January 1, 2008 shall have their service credit calculated based upon their combined service earned during their employment with as a district employee and as a city employee;

    D.

    Any former district employee who does not become a city employee shall have the opportunity to apply for a retirement, if vested, or a refund of their contributions, but such application for retirement must be made within thirty days from the date of termination from the district, or December 31, 2007 if district employment is not terminated prior to the district's dissolution;

    E.

    Any former district employee who becomes a city employee on January 1, 2008 shall have the right to pay into the pension fund for any time their salaries are paid partially or entirely from county, state or federal grant funds on the terms and conditions pursuant to Section 2.64.140(E) regardless of whether the employee has been a classified or nonclassified employee at the district or the city;

    F.

    Any former district employee who becomes a city employee on January 1, 2008 shall have the same rights to pay into the pension fund for any time for which the employee was on leave as any other city employee pursuant to Section 2.64.260(B).
