§ 12.16.020. Required—Defense to prosecution.

It shall be a defense to prosecution under this chapter that the person:
A.

Was physically incapable of making a required accident report;

B.

Complied with all applicable requirements of Chapter 550, Texas Transportation Code, but left the scene of the accident prior to the arrival of a police officer in order to obtain medical care for himself or herself or an occupant of his or her vehicle; or

C.

Made the required accident report and complied with all applicable requirements of Chapter 550, Texas Transportation Code, but left the scene of the accident prior to the arrival of a police officer after waiting thirty minutes at the scene after reporting the accident and no officer arrived at the scene within that time.
